Public Charge rule changes effective September 18, 2026 — broadens benefits considered in I-485 adjudication
On August 18, 2026, USCIS issued updated guidance on the public charge ground of inadmissibility, effective September 18, 2026. Starting that date, any means-tested public benefits received on or after September 18 will be considered in the public charge determination for all Form I-485s filed on or after that date. Previously, only cash assistance and institutionalization counted.

USCIS published revised guidance in its Policy Manual on August 18, 2026, implementing a final Department of Homeland Security rule published in the Federal Register on July 20, 2026. The rule becomes effective on September 18, 2026.
Under the revised standard, USCIS will evaluate means-tested public benefits differently based on receipt date:
- For benefits received before September 18, 2026, USCIS considers only cash assistance for income maintenance and long-term institutionalization at government expense. - For benefits received on or after September 18, 2026, USCIS will consider any and all means-tested benefits when evaluating public charge inadmissibility.
Means-tested benefits include programs such as Supplemental Security Income (SSI), Temporary Assistance for Needy Families (TANF), Supplemental Nutrition Assistance Program (SNAP), and Medicaid. The change applies to all I-485 applications postmarked or electronically submitted on or after September 18, 2026.
USCIS adjudicators will continue to apply the five statutory factors — age, health, education, skills, and resources — and consider the totality of circumstances in each case. However, the addition of any means-tested benefits to the calculus significantly changes the evidentiary burden for applicants, particularly those in economically vulnerable positions.
